“Why do the Falklands islanders have the right to decide…” in Argentina 23rd June 2015


“Why do the Falklands islanders have the right to decide…” Just imagine asking the question in Argentina. Dr Jorge E. Núñez, Lecturer, from Manchester Law School here in MMU is right now in Argentina acting as Visiting Professor delivering lectures and presentations. And he will be asking and answering the question right in Buenos Aires capital city, La Plata, next week.


 
The School of Law, National University of La Plata—in Spanish, Facultad de Ciencias Juridicas y Sociales, Universidad Nacional de La Plata—and La Plata’s Law Society—in Spanish, Colegio de Abogados de La Plata—have invited Dr Núñez to deliver a joint presentation about his research on the “Egalitarian Shared Sovereignty as a new mode of governance: the Falklands Case.” The presentation will take place on Tuesday 23rd June from 6pm in Buenos Aires capital, the city of La Plata.

Amongst the notable UNLP’s alumni are Nobel Peace laureate Adolfo Perez Esquivel and current Argentina’s President Cristina Fernandez de Kirchner.

Soberanía compartida en el contexto de dos Estados: un problema de justicia distributiva

Resumen La mayoría-si no todos-los conflictos en relaciones internacionales tienen algo que ver con soberanía. En el aspecto teórico, nos enseñan en la Universidad que tanto considerado como un concepto fundamental cuanto uno que ha perdido relevancia, todavía se discute. En el aspecto real, las prerrogativas que un Estado tiene sobre la población y el territorio parece ser el más alto. En este contexto a la vez ideal y real, existen varias disputas de soberanía en todo el mundo que  transitan entre el limbo jurídico y político, status quo y la tensión continua con diversas consecuencias negativas para todas las partes involucradas (e.g. violación de derechos humanos, guerra, tráfico de armas, sólo por nombrar algunos). Cada vez es más evidente que los remedios disponibles son inútiles, y una solución pacífica y definitiva se necesita. Este artículo busca presentar algunos de los argumentos propuestos en la Tesis Doctoral ‘Soberanía compartida en el contexto de dos estados: un problema de justicia distributiva’. La tesis en cuestión demuestra una forma equitativa y justa de abordar ciertos conflictos de soberanía.

Sovereignty conflicts as a distributive justice issue: a new mode of governance and the Falklands

Abstrasct Most—if not all—conflicts in international relations have—to an extent—something to do with sovereignty. On the theoretical side, we learn at University that either considered as a strong concept or one that has lost relevance, it is still discussed. On the practical side, the prerogatives a State has over its people and territory appear to be the highest. Within these ideal and real backgrounds, there are various sovereignty disputes around the world that struggle between legal and political limbo, status quo and continuous tension with various negative consequences for all the involved parties (e.g. violation of human rights, war, arms trafficking, only to name a few). It is increasingly clear that the available remedies have been less than successful, and a peaceful and definitive solution is needed. This article proposes a fair and just way of dealing with certain sovereignty conflicts—e.g. Russia, Ukraine, and Crimea; Argentina, the United Kingdom, and the Falklands. The paper considers how distributive justice theories can be in tune with the concept of sovereignty and explores the possibility of a solution for sovereignty conflicts though a new mode of governance. I argue that the solution can be based on Rawlsian principles.

Resumen Este artículo considera las dos principales tesis que Schauer introduce en La Fuerza de Derecho. En primer lugar, busca establecer que la coacción o coerción es (a) generalmente parte del derecho; y (b) ocasionalmente puede no serlo. En segundo lugar, intenta demostrar que a pesar que la relación entre las normas y los hechos o actos dentro de un sistema normativo podría ser necesaria, suficiente o deseable, en todos los casos es sinérgica. La última sección de este trabajo muestra que la coacción o coerción tiene interés filosófico en la explicación de la naturaleza del derecho puesto que la cuestión de si se trata de un elemento necesario o suficiente es irrelevante.

Abstract This paper considers the two claims Schauer introduces in The Force of Law. Firstly, the paper seeks to establish that coercion is (a) generally part of the law; and (b) occasionally may be not. Secondly, I intend to demonstrate that despite the fact that the relationship between rules and facts within a normative system could be necessary, sufficient or desirable, in all cases is a synergetic one: they outperform when they work together. Therein, the last section of this paper shows that coercion has philosophical interest in explaining the nature of law since the question whether it is a necessary or sufficient element is irrelevant.
